Terms and COnditons

 

1. Definitions

"eLifeTech" shall herein refer to the company known as eLifeTech Limited.

"Working days" pertain to weekdays, excluding official public holidays and weekends.

"Force Majeure" encompasses any unforeseen event that may impede eLifeTech Limited's capacity to fulfil its obligations. Such events include, but are not limited to, government regulations, natural disasters, fires, floods, and industrial disputes.

"Catalogue" pertains to the range of products made available by eLifeTech Limited, accessible on the website www.elifetech.co.uk.


2. Contracts of Sale

All contractual agreements for the sale of products established by eLifeTech Limited shall be governed by the terms and conditions outlined here in. These terms and conditions take precedence over any other terms presented by the party ("the Customer") to whom eLifeTech Limited is selling. Cancellation of orders placed by business customers will be considered solely at the discretion of eLifeTech Limited and cannot be entertained if goods have been dispatched on the same day as the order placement. For consumers, cancellation of orders must align with the guidelines set forth by the Consumer Protection (Distance Selling) Regulations 2000.

Acceptance of all orders is contingent upon eLifeTech Limited's approval and the availability of the requested goods. eLifeTech Limited reserves the prerogative to reject any order.

The Customer is obligated to ensure that all details provided for the purchase of goods through our website are accurate.

Additionally, the Customer asserts that the credit card or debit card used for purchasing goods belongs either to them personally or to their respective company, and they possess the necessary authorization for its use. Furthermore, the Customer commits to ensuring that sufficient funds are available to cover the cost of the ordered goods. eLifeTech Limited reserves the right to verify the validity of credit or debit card details before supplying goods.


3. Terms & Conditions of Sales

The terms and conditions outlined herein apply to orders placed via phone, email, or online channels.

Title to the product shall remain vested in eLifeTech Limited and shall not transfer to the Customer until full payment for the product has been received by eLifeTech Limited. Until the title to the product has been transferred:

  • eLifeTech Limited retains the authority to recover, sell, or otherwise deal with any or all parts of the product.
  • eLifeTech Limited, its agents, and employees are entitled to enter, at any time and without prior notice, any property on which the product or any part thereof is stored, or any property where eLifeTech Limited reasonably believes the product is stored. The Customer is required to store or label the product in a manner acceptable to eLifeTech Limited, indicating that the title to the product remains vested in eLifeTech Limited.
  • The Customer is obliged to insure the product for its full replacement value and add eLifeTech Limited as the loss payee on the insurance policy.


4. Prices

Goods are invoiced based on the prevailing prices at the time of order placement. Invoices will be subject to VAT unless explicitly stated otherwise. Rates for overnight delivery services will be invoiced as per the rates displayed on the website, unless alternative arrangements have been agreed upon.

eLifeTech Limited retains the right to adjust pricing as needed, periodically.


5. Delivery, Title, and Risk

Estimated times and dates for delivery are provided for reference purposes only. While every effort is made to meet Customer requirements and deadlines, eLifeTech Limited cannot accept liability for any failure to deliver within the specified timescales.

In the unlikely event that eLifeTech Limited is unable to deliver goods, the Customer will be given the option to either cancel the order or choose from alternative available goods. If a written order has been received, written cancellation must be submitted to eLifeTech Limited.

eLifeTech Limited cannot assume liability for damage or incomplete deliveries unless such issues are reported by the Customer within 3 days of delivery. The Customer is responsible for accepting delivery of goods once they are ready for dispatch.

Delivery is considered complete once the goods have been delivered to the Customer's designated delivery address. At this point, all risk of loss, breakage, and damage is transferred to the Customer.

Title to the goods only transfers from eLifeTech Limited to the Customer upon full payment.


6. Payment

The standard payment terms require debit or credit card payment at the time of order placement. Alternative terms may be agreed upon at eLifeTech Limited's discretion and must be documented in writing.

Should alternate payment terms be arranged, and payment is not received by the due date, eLifeTech Limited reserves the right to impose interest charges on any outstanding balance at a rate 3% above the base lending rate of Barclays Bank plc, applicable at the time.


7. Product Specifications

Goods may be subject to minor variations in actual dimensions, specifications, and quantities. In such cases, if the Customer prefers not to accept the alternative goods, they reserve the right to cancel the order and receive a refund of any monies paid to eLifeTech Limited for that order. This will be the sole recourse available to the Customer in such circumstances.


8. Trade Names and Trade Marks

Trade names and marks may not always conclusively identify the actual manufacturer of a specific product and may instead denote general-use systems and equipment related to those products.

For components, buyers seeking products from a particular manufacturer should verify the identity of the component's actual manufacturer prior to purchase.


9. Warranties and Returns

While eLifeTech Limited is committed to delivering products and services of the highest quality, there may be instances when products are found to be faulty or defective. In such cases, the following provisions apply:

  • All products supplied by eLifeTech Limited are warranted to be free from any significant defect in workmanship and materials and suitable for their intended use. If products or services are procured within the scope of the Customer's business, they are exempted to the maximum extent permitted by law from all other express or implied terms or warranties.
  • If eLifeTech Limited agrees to accept the return of unwanted products for replacement or credit, such products must be returned with eLifeTech Limited's explicit written consent within 7 days of the delivery date. The products must remain unopened and in impeccable, resalable condition. There will be no charge for goods returned under these circumstances. If returned goods are not in their original packaging, they may be subject to a restocking fee ranging from 15% to 30% of the goods' sales value, or £25.00, whichever is greater.
  • eLifeTech Limited reserves the right to test products alleged to be faulty upon return for replacement or credit. Any faults must be reported within 7 days of the delivery date.
  • eLifeTech Limited's customer support staff will advise on the most suitable method for returning goods, whether through courier collection or postal delivery directly to eLifeTech Limited. The customer is responsible for ensuring their availability to hand over the relevant goods if courier collection is arranged.
  • All returned goods must bear an eLifeTech Limited Returns Authorization Number, which will be provided by our customer support staff upon request. No goods will be accepted for return without this number, which must be clearly indicated on the external packaging. Failure to adhere to this procedure may result in delays and additional costs.
  • Regarding the return of faulty goods, it is the Customer's responsibility to adequately package the goods. eLifeTech Limited cannot accept responsibility for goods damaged in transit due to insufficient packaging.
  • Proof of postage does not constitute proof of delivery. Customers are advised to send returned goods via recorded delivery, registered post, or courier, with sufficient insurance coverage to match the replacement value of the goods.
